Settlement in sight
City moves forward on reaching agreement with Breanne Sharpe’s mother
The city of Chico will pursue a settlement with Mindy Losee, who sued the city after her 19-year-old daughter, Breanne Sharpe, was killed inside her car by police officers following a high-speed chase in 2013.
During the City Council’s closed session Tuesday (Oct. 2), City Attorney Vince Ewing was directed to proceed with “settlement authority” on a 6-1 vote, with Councilman Randall Stone against.
This June, the Ninth U.S. Circuit Court of Appeals upheld the district court’s dismissal of four involved officers, but reversed the dismissal of an excessive force claim against former Sgt. Scott Zuschin. “The right not to be shot in a car that poses no immediate danger to police officers or others is clearly established,” the court decision reads.
