County sued over Measure A
Pot advocates are attempting to prohibit enforcement of the law
A lawsuit has been filed to overturn Measure A, the local ordinance enacted by Butte County voters in November to restrict the physical size of medical marijuana gardens.
The lawsuit was filed in Butte County Superior Court on Tuesday (Feb. 3) by San Rafael attorney Scot Candell, who is representing Donald Ehrsam, Raymond Sperry and Gina Endler of Oroville and Douglas Gunning of Berry Creek. Candell told the CN&R by phone that Measure A “violates the spirit of [California’s] Compassionate Use Act—that everyone can get their medicine, and everyone is treated equally.”
The lawsuit seeks an injunction prohibiting enforcement of the ordinance.
